Victims of car thefts, home invasions, and other property crimes in the Portland region say they are frustrated that the people responsible for these crimes aren’t being brought to justice. However, this will all be changing in Multnomah County as of Thursday, June 01.
Chief Criminal Court Cheryl Albrecht signed the order and stated that a court may require a person accused of a third property crime to remain in custody until arraignment.
The new directive will provide judges with additional discretion when deciding whether or not to release defendants from jail pending trial.

“What now happens is that instead of using a score, their recognizance officer looks at what their criminal history is, or what their pending charges are, and using that information, makes the decision and determines whether they can be held pending arraignment, or release pending arraignment,” Albrecht explained.

A new state law intended to curb bias played a role in this judgment. Inmates were released without posting bail under Senate Bill 48, which became law in 2021. Prosecutors hope this will ensure repeat offenders of property crimes remain incarcerated at least until their day in court.
