Final Psilocybin Services Act: The Oregon Health Authority (OHA) has taken the necessary steps to create the first regulatory framework in the country that is specific to psilocybin services by adopting the final set of administrative rules. The public comments were summarised in a Hearing Officer Report and a Letter to the Public, both of which outlined choices that were taken based on feedback received during the public comment period. Final Psilocybin Services Act Regulations Have Been Published by OHA
The Oregon Psilocybin Services Act, also known as Ballot Measure 109, is put into effect by the rules, which are now included in ORS 475A, which is the section of Oregon law that codifies the statute. Following the approval of these rules, the Oregon Psilocybin Services (OPS) section will, on January 2, 2023, start the process of accepting applications for four different types of licences.

The OHA is responsible for regulating these licences as part of their responsibilities. Those that operate outside the licenced system run the risk of facing criminal sanctions, which are a matter for law enforcement agencies at the municipal, county, or state level.

A client who is at least 21 years old and who wishes to receive psilocybin services may do so in accordance with ORS 475A; however, prior to engaging in an administration session, the client must first complete a preparation session with a qualified facilitator. During the course of the administration session, the client will only have access to psilocybin while they are in a licenced service facility. Integration sessions, which are intended to provide customers with further help, will be made accessible following administration sessions.

Before being offered for sale to licenced service centres, psilocybin products must first undergo cultivation or processing by licenced producers and then testing by approved and recognised testing laboratories. Service centres are the only licensees permitted to sell items containing psilocybin to customers, and these sales can only be made for clients who intend to consume the products within the confines of a licenced service centre during administration sessions.
