The New York Times reported that this summer, a special grand jury in the investigation heard prosecutors question witnesses about Giuliani’s appearance before Georgia lawmakers in December 2020, where he spread various allegations of election fraud and urged officials to appoint pro-Trump electors in the state.

According to the newspaper, Giuliani will go before that grand jury on Monday in a courtroom in Atlanta.

Giuliani’s involvement in the investigation was initially made public by The Times. Giuliani’s lawyer, Robert Costello, verified via email to CNBC that Bill Thomas, a different member of Giuliani’s legal team, had heard such information from a prosecutor.

Giuliani will probably claim executive privilege if he is questioned about his interactions with Trump, according to Costello, who told the Times.

Sen. Lindsey Graham, R-South Carolina, asked a federal judge earlier on Monday to toss out a subpoena for his testimony before the Fulton County grand jury, but the judge refused. Graham, a witness in the investigation, must appear before the grand jury on August 23 according to the subpoena.
